OFFICIAL RULES
NO PURCHASE NECESSARY

1.  ELIGIBILITY: This contest is open to legal U.S. residents, 18 years or older.  The contest will run from May 28, 2009 at 12:01:00 AM (EDT) through December 31, 2009 at 11:59:59 PM (EST) for submissions and online voting.  The Grand Prize winner will be announced on or about January 15, 2010.   

2. HOW TO ENTER: Entrants are invited to submit funny, adventurous or exciting photos including any PEANUT CHEWS® Brand product to Just Born, Inc. (hereinafter referred to as “Sponsor”).  Only photos containing a PEANUT CHEWS® product will be accepted.  Submissions that are lewd, obscene, pornographic, disparaging, or otherwise in poor taste or inappropriate will be disqualified at the Sponsor’s sole discretion and will not be posted.  By submitting a photo, you represent that you are the owner of the copyright therein and have all necessary permissions and rights as described in these Rules.   

To enter, go to www.peanutchews.com for complete online registration process details (and photo size/resolution requirements) and information on uploading your photo to the website. All online entries must be received by November 30, 2009 at 11:59:59 PM (EST). By submitting, you agree to the posting of the photograph for judging.  Photos become the property of Just Born, Inc. to be used at its sole discretion in perpetuity.  
Sponsor is not responsible for any fraudulent submissions.

3. PRIZE JUDGING: All entries will be initially screened by representatives of the Sponsor to assure, at its sole discretion, that there is no inappropriate content.  All appropriate photos will be posted at www.peanutchews.com on an as-received basis commencing at 12:01:00 am EDT on May 28, 2009 and ending at 11:59:59; pm EST on November 30, 2009.  Members of the general public will be given the opportunity to vote for their favorites. Limit one vote per person per day. The ten entries with the highest number of votes at the end of the Promotion at 11:59:59; pm EST on December 31, 2009 will be posted online on or about January 6, 2010 and will be judged by a panel of judges based on the following criteria (weighted equally): originality, use of PEANUT CHEWS® product, and use of humor. Decisions of judges will be announced on or about January 15, 2010 and decisions of judges are final.  Ties will be broken by the judges.

4. PRIZES AND APPROXIMATE RETAIL VALUES: One Grand Prize Winner will receive a check for $3,500 to plan an “adventure” vacation of his/her choice, a camcorder (ARV $500) to be chosen by Sponsor and a PEANUT CHEWS® product package (ARV $50). Total ARV of grand prize is $4,050. Winner may be asked to submit photos or video from trip for sponsor use without additional compensation.  Nine remaining finalists shall be First Prize Winners and shall receive a $100 pre-paid credit card and a PEANUT CHEWS® product package (ARV of $50), with a total approximate prize value of $150.  Total ARV of all prizes is $5,400.  All photos and associated copyrights will become the property of Sponsor upon submission. Sponsor will have full rights to use all photos submitted in perpetuity. Limit one prize per household or family.

5.  CONDITIONS OF PARTICIPATION:  Employees of Just Born, Inc., Salt Communications, and their respective parents, affiliates, subsidiaries, advertising and promotion agencies (together "Indemnities") and their immediate family members and/or those living in same household of each are not eligible.  No substitution or transfer of prize permitted by winner.  Sponsor reserves the right to substitute prizes of equal or greater value in the event that the prize offered is not available. Any federal, state and local taxes that may be required are the sole responsibility of winner.   All federal, state, and local laws and regulations apply.  Void in Puerto Rico and where prohibited by law. All winners must sign and return an Affidavit of Eligibility and Liability/Publicity Release, within 7 days of first attempted notification.  Noncompliance within this time period will result in disqualification and an alternate will be selected.  If any winner is less than the age of majority in his/her state of residence, any required documents must be signed by winner’s parent/legal guardian on his/her behalf.  Minors must travel with parent or legal guardian, who must sign all documents on minor's behalf.  By entering the contest, the entrant represents and warrants that he/she owns or controls all rights, including copyrights, necessary for the posting of their submitted photos on website and gives the Sponsor the right to use, edit, or publish their entries and photographs without compensation.  You warrant your entry is your sole work and that you have acquired all rights necessary (including without limitation any permissions for individuals featured in Entry photographs) and will produce these documents upon request to allow Just Born, Inc. to use your Entry as described in these Rules.  You also warrant and represent that your Entry has not been previously published nor has it won previous awards and that you have obtained the written consent of any identifiable persons in the Entry Content to use their likenesses in connection with this Contest and you have obtained permission from any third party intellectual property rights holders and you will provide such permissions and accompanying documentation at Sponsor's request.  Also without further compensation, winners assign all rights, title and interest in their submission to the Sponsor and, if required, will sign any documents necessary to transfer copyright.  By entering contest and/or accepting prize, entrants grant permission to Sponsor and their agencies to use winner’s names and/or likenesses and/or photographs for purposes of advertising/trade, without further compensation to entrants unless prohibited by law.  By accepting prize, winner agrees to hold Indemnities, their respective directors, officers, employees and assigns, harmless against any and all claims and liability arising out of use of prize.  Winners assume all liability for any injury or damage caused, or claimed to be caused, by participation in this promotion or use/redemption of any prize. Entrants agree to be bound by the Official Rules and the decisions of the Sponsor.  Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the contest or in the announcement of the prizes.  By participating in this promotion, entrants agree to be bound by the Official Rules and the decisions of the judges whose decisions are final. Sponsor is not responsible for lost, late, mutilated or illegible entries nor for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations or distortions of photos or entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive entry information by Sponsor on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof. If for any reason the Internet portion of the program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this contest the Sponsor, in its sole discretion, reserves the right, but not the obligation to suspend modify or terminate the contest.  The Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the contest. Caution: Any attempt by a contestant to deliberately damage any website or undermine the legitimate operation of the game is a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such contestant to the fullest extent of the law.
